Introduction
Welcome to Bird’s Eye Unmanned (“we”, “us”, “our”, “the Company”). These Terms & Conditions (“T&Cs”) govern your access to and use of our website (https://birdseyeunmanned.com
), our services (listed on our Services page), and any contract for services between you (the “Client”) and us (the “Company”). By using our website or engaging our services, you agree to be bound by these T&Cs.
Services
We offer a range of aerial drone services including (but not limited to) aerial mapping & surveying, construction & infrastructure imaging, real estate & marketing aerial photography, agriculture & environmental monitoring, industrial inspections, disaster response/imaging, mining & energy sector services, film & media production, collision reconstruction, building maintenance, and government & municipal aerial solutions. Service engagements are subject to separate quotes and contracts. Unless otherwise specified, all services are subject to these T&Cs.
Estimates & Quotes
We provide free estimates for all our services. Birdseye UAS+1
A formal quote will be provided to the Client detailing scope, deliverables, timelines, cost, and any additional terms. Acceptance of the quote (or execution of a Services Agreement) constitutes your agreement to pay for the services and to abide by these T&Cs.
Payment & Fees
Payment terms will be specified in the quote or service agreement. Unless otherwise stated:

An initial deposit (e.g., xx %) may be required before work commences.

Final payment is due upon delivery of the agreed deliverables or as otherwise stated.

Late payments may incur interest or suspension of services.
Client Responsibilities
The Client must:

Provide accurate information and necessary access, permissions, and site conditions for the Company to perform the services.

Ensure that any relevant regulatory or local permissions (e.g., drone flight permissions, site access) are obtained unless specifically agreed otherwise.

Cooperate with the Company’s engineers and staff as needed.

Comply with any safety or operational instructions provided by the Company.
Company Responsibilities & Standards
We will perform the services with commercially reasonable skill and care, using appropriate equipment, personnel, and workmanship consistent with industry standards (drone-based aerial services).
We will deliver the agreed upon scope of work, subject to site conditions, weather, regulatory constraints, and force-majeure events.
Deliverables & Intellectual Property

Deliverables (e.g., maps, imagery, 3D models, video, inspection reports) will be delivered in the format and timeline as set out in the quote/service agreement.

Unless otherwise agreed, the Company retains ownership of raw data and imagery; the Client is granted a non-exclusive, non-transferable license to use the final deliverables for the agreed purpose.

The Client may not resell, distribute or publish the deliverables (or raw data) for purposes outside the agreed scope without prior written consent.

If the Client wishes additional rights (e.g., commercial redistribution, sub-licensing), a separate agreement must be made.
Changes & Cancellations

Any modifications to scope, schedule, deliverables, or payment must be agreed in writing by both parties.

The Client may cancel or postpone a scheduled service subject to the terms in the quote/service agreement (e.g., cancellation fees, cost of mobilization).

The Company may cancel or postpone services due to weather, regulatory changes, site conditions, safety concerns, or other unforeseen circumstances; we will notify the Client as soon as is practical.
Limitations & Liabilities

To the fullest extent permitted by law, the Company’s liability for any claim arising out of or related to the services is limited to the total amount paid by the Client under the service agreement.

The Company is not liable for indirect, incidental, consequential, punitive or special damages.

The Company is not responsible for the Client’s decisions or actions taken based on the deliverables. The Client remains responsible for verifying and applying the data in its own context.

The Client acknowledges that aerial drone operations may be subject to regulatory, weather and operational risks, and the Company cannot guarantee uninterrupted or perfect service.
Regulatory Compliance & Safety
The Company will comply with applicable federal, state and local regulations governing drone operations, privacy, airspace, and site safety. The Client must ensure that the site and project comply with any local regulations and that the Company can lawfully and safely perform the services.
Use of Website & Content

The Company’s website (and blog) provides information about the services offered, company background, articles, and resources. Use of the website is subject to our Privacy Policy (if any) and these T&Cs.

The Client or any website visitor must not copy, reproduce or distribute website content without express written consent of the Company.

The blog section (e.g., “Recent Posts” in Government & Municipal, Film & Media, Mining & Energy categories) provides informational content and does not constitute professional advice.
Privacy & Data Protection
The Company will handle Client data (personal or project-related) in accordance with applicable privacy laws and our Privacy Policy (link to be provided). The Client consents to our collection and processing of such data as required to provide the services.
Confidentiality
Each party agrees to keep confidential all non-public information disclosed by the other party in connection with the services, unless disclosure is required by law or with the other party’s written consent.
